These Terms of Service ("Terms") govern the use, purchase, licensing, commissioning, distribution, modification, and access of all products, services, intellectual property, and digital content produced, distributed, or owned by Trufire and its affiliated brands, divisions, and subsidiaries.By accessing, downloading, commissioning, purchasing, modifying, distributing, or otherwise using any Trufire product or service, you acknowledge that you have read, understood, and agree to be bound by these Terms.These Terms apply to all products and services provided by Trufire and any subsidiery company, brand or orginisation operating in partership with Trufire Studios, including but not limited to; Digital assets, Software and scripts, User interfaces, Textures and graphics, Vehicle liveries, 3D models, Branding and design services, Website development, Commissioned works, Training and documentation materials, Media production, Content distributed through subsidiary brands
For the purposes of these Terms:"Trufire", "we", "our", or "us" refers to Trufire and its affiliated entities.
"Customer", "User", or "You" refers to any individual, organisation, server owner, community, business, or other entity using our products or services.
"Subsidiary Brand" refers to any project, division, or trading name operating under Trufire, including but not limited to How Good Designs.
Unless explicitly stated otherwise in a written agreement signed by an authorised representative of Trufire, all intellectual property rights, title, and interests in any work created, developed, designed, authored, or otherwise produced by Trufire shall remain the sole and exclusive property of Trufire.
This includes source code, software applications, scripts, plugins, automation systems, frameworks, libraries, development tools, user interface and user experience designs, graphic designs, digital artwork, logos, branding, visual identity systems, textures, materials, digital assets, 3D models, animations, renders, documentation, manuals, technical guides, training materials, educational content, photography, photographic works, video productions, recordings, multimedia content, websites, web applications, online services, concepts, prototypes, design drafts, development methodologies, workflows, processes, databases, configurations, supporting files, research, planning documents, project specifications, trademarks, service marks, proprietary branding, and any derivative works, adaptations, revisions, or improvements created by Trufire.
The provision of a product, service, commissioned work, or deliverable does not constitute a transfer of intellectual property ownership unless such transfer is expressly documented within a separate written agreement.
Where ownership is not transferred, the client is granted only those usage rights expressly outlined within the relevant project agreement, quotation, invoice, licence agreement, statement of work, or other written agreement.
Trufire retains the right to reuse non-client-specific methodologies, techniques, development practices, workflows, systems, and knowledge acquired during the course of a project. Trufire also reserves the right to retain copies of project materials for archival, legal, compliance, disaster recovery, and portfolio purposes unless otherwise agreed in writing.
Clients shall not claim ownership of Trufire intellectual property, remove copyright notices, trademarks, watermarks, attribution information, redistribute or resell Trufire intellectual property beyond the rights expressly granted to them, sublicense Trufire intellectual property to third parties without written permission, or reproduce, copy, reverse engineer, or create competing products from proprietary Trufire works where prohibited by law or contractual agreement.
Where a project incorporates intellectual property, branding, media, or materials supplied by the client, ownership of those materials remains with their respective owners. The client warrants that they possess all necessary rights, permissions, licences, and authorisations required to provide such materials to Trufire for use within the project.
Any transfer of intellectual property ownership, source files, development files, trademarks, exclusive rights, or other proprietary materials must be expressly stated in writing and may be subject to additional fees, licensing requirements, contractual conditions, or separate agreements.
All rights not expressly granted to the client are reserved by Trufire.
Trufire may release products, services, assets, software, media, documentation, and other intellectual property under a variety of licensing models, including Proprietary Licences, Creative Commons Licences, Open Source Licences, Custom Commercial Licences, or other licensing arrangements as determined by Trufire.
The applicable licence will be identified on the product release page, accompanying documentation, invoice, quotation, distribution platform, or within the files themselves where practical.
Users are responsible for ensuring they comply with the terms of the licence associated with the product they are using. The purchase, download, or use of a product does not transfer ownership of the underlying intellectual property unless expressly stated in writing.
Products released under Proprietary Licences remain the exclusive property of Trufire and may not be copied, modified, redistributed, sold, or otherwise exploited beyond the rights granted by the licence. Products released under Creative Commons, Open Source, or Custom Commercial Licences must be used in accordance with the terms of the applicable licence.
Where no licence is explicitly provided, the product shall be considered proprietary intellectual property owned exclusively by Trufire, with all rights reserved.
Commercial use of Trufire products, services, assets, or intellectual property is prohibited unless expressly permitted by the applicable licence or authorised through a separate written agreement with Trufire. For the purposes of these Terms, commercial use includes any activity intended to generate revenue, financial benefit, business advantage, or commercial gain, whether directly or indirectly.
Commercial use may include, but is not limited to, the resale of products, redistribution for profit, inclusion within paid products or services, paywalled access, subscription-based services, asset packs, commercial training systems, corporate deployments, white-label solutions, or the incorporation of Trufire intellectual property into commercial projects.
Any commercial rights granted by Trufire shall be limited to those expressly stated within the applicable licence or written agreement. All commercial rights not expressly granted are reserved by Trufire.
Upon acceptance of a quotation, estimate, proposal, invoice, or other written agreement, the customer agrees to the scope of work, pricing, timelines, and conditions outlined therein.
Unless otherwise agreed in writing, Trufire retains ownership of all development methodologies, concepts, templates, workflows, tools, and underlying intellectual property used in the creation of commissioned works. The customer is granted the right to use the completed deliverables for their intended purpose, subject to any licensing terms or restrictions specified within the project agreement.
Ownership of commissioned works, source files, development files, or associated intellectual property shall only transfer where such transfer is expressly stated in writing. The delivery of a completed project does not, by itself, constitute a transfer of ownership.
All estimates, quotations, and proposals are indicative only and may be adjusted where project requirements change, additional work is requested, unforeseen complexities arise, or information provided by the customer is inaccurate or incomplete.
Customers may request cancellation of commissioned work within seventy-two (72) hours of project commencement. Where substantial work has already been completed, resources allocated, or third-party expenses incurred, Trufire reserves the right to retain any deposits paid and recover costs associated with work already undertaken.
Trufire reserves the right to archive project files and records for administrative, legal, and business purposes. Unless otherwise agreed, Trufire is under no obligation to retain project files indefinitely following completion of a commission.
Unless otherwise prohibited by the applicable licence, users may create derivative works based upon Trufire products, assets, software, designs, or other intellectual property, provided that appropriate attribution is maintained, original copyright notices remain intact, and the derivative work does not falsely imply endorsement, affiliation, or sponsorship by Trufire.
Any derivative work must comply with the terms of the original licence, all applicable laws, and any platform-specific policies relevant to the product's intended use. Users may not remove, obscure, or replace Trufire branding, copyright notices, watermarks, or attribution requirements where such notices are required by the applicable licence.
Where a product is released under a No-Derivatives Licence, Proprietary Licence, or other licence restricting modification, adaptation, or redistribution, the creation of derivative works is prohibited without prior written permission from Trufire.
Trufire reserves all rights not expressly granted under the applicable licence.
Users must not remove or alter copyright notices, trademarks, licensing information, watermarks, or other proprietary markings; misrepresent ownership or authorship of any Trufire product or intellectual property; reproduce, distribute, resell, or commercially exploit products beyond the rights granted by the applicable license; circumvent licensing, authentication, payment, or security systems; reverse engineer protected products except where permitted by law; distribute malware or malicious code; use Trufire products or services for unlawful purposes; or use Trufire intellectual property in a manner likely to harm the reputation, business interests, or goodwill of Trufire or its affiliated brands.
Any violation of these Terms may result in the suspension or termination of licenses, revocation of access to products or services, restriction of support, legal action, copyright enforcement measures, including DMCA takedown notices, and any other remedies available under applicable law.
Certain Trufire products may be developed for, designed to operate with, or distributed through third-party platforms, software, services, or game modification frameworks. Users are responsible for complying with all applicable terms, conditions, policies, and licensing requirements imposed by the respective platform providers.
Unless expressly stated otherwise in writing, Trufire is not affiliated with, endorsed by, sponsored by, or associated with any third-party platform, publisher, developer, or rights holder. All trademarks, product names, and intellectual property referenced remain the property of their respective owners.
Clients are responsible for providing accurate, complete, and up-to-date information necessary for the delivery of services and must ensure that any materials supplied to Trufire are lawfully owned or appropriately licensed for use. Clients must respond to reasonable requests for feedback, approvals, or additional information in a timely manner, acknowledging that delays in communication may impact delivery timelines.
Clients represent and warrant that all instructions, assets, and materials provided to Trufire do not infringe upon any third-party rights, including but not limited to intellectual property, privacy, or contractual rights. Trufire shall not be held liable for delays, additional costs, or failure to meet agreed timelines arising from incomplete information, inaccurate materials, or client inaction.
Clients may supply materials including, but not limited to, logos, branding assets, images, text, models, audio, and documentation for use in connection with commissioned work or services. By providing such materials, the client represents and warrants that they hold all necessary rights, licences, and permissions required for Trufire to use, modify, reproduce, and incorporate those materials for the purpose of delivering the agreed services.
The client is solely responsible for ensuring that any materials supplied do not infringe upon the intellectual property rights, moral rights, privacy rights, or any other rights of any third party. Trufire accepts no liability for any claims, disputes, losses, or damages arising from or relating to client-supplied materials, including but not limited to allegations of copyright infringement, trademark infringement, or licensing violations.
Trufire respects the intellectual property rights of all third parties and operates in accordance with applicable copyright, trademark, and intellectual property laws.
Trufire reserves the right to refuse, modify, or decline any request, instruction, or project where there is reasonable concern that the materials provided or requested may infringe upon third-party intellectual property rights, including but not limited to registered trademarks, copyrighted logos, protected branding, or other commercial intellectual property.
Where a client supplies or requests the use of such materials, the client must be able to demonstrate that they hold the necessary rights, licences, or permissions for their intended use.
Acceptance or commencement of a project does not constitute legal verification, endorsement, or validation of the client’s rights to use any supplied or referenced materials, and Trufire disclaims any responsibility for verifying ownership or licensing status beyond reasonable professional diligence.
Due to the digital nature of Trufire products and services, all sales are generally considered final and non-refundable once access, delivery, or download has been provided.
Commissioned work may be cancelled within forty-eight (48) hours of acceptance and will be eligible for a refund provided that no substantial work has commenced; where work has already commenced or significant resources have been allocated, Trufire may issue a partial refund at its discretion based on the work completed to date.
Commissioned work is otherwise non-refundable once development or production has commenced, except where required by applicable law or expressly agreed in writing.
Where a product is found to be defective, corrupted, or otherwise unusable as delivered, Trufire may, at its discretion, provide a replacement, repair, or reissue of the affected files where reasonably possible.
Any refund requests are assessed on a case-by-case basis and remain subject to the sole discretion of Trufire. Chargebacks or payment disputes initiated without prior contact or good-faith resolution attempts may result in suspension or restriction of access to products, services, and support.
All payment terms, including pricing, deposit requirements, milestone structures, and due dates, will be specified in the relevant quotation, invoice, or written agreement provided by Trufire for each project.
Trufire reserves the right to require upfront deposits prior to commencement of work, as well as progress or milestone-based payments during the course of a project where applicable.
Trufire may suspend or pause any ongoing work, services, or access to deliverables in the event of overdue or unpaid accounts until all outstanding balances are settled in full. Final deliverables may be withheld until all payment obligations have been satisfied.
Failure to pay outstanding invoices may result in debt recovery action and the engagement of third-party collection services, in addition to any other rights or remedies available under applicable law.
Unless otherwise expressly agreed in writing, Trufire is not obligated to provide ongoing support, maintenance, updates, or modifications following delivery or completion of a project.
Where support is provided, it is offered on a best-effort basis only and does not constitute a guarantee of availability, response time, or resolution. Any ongoing maintenance, support, or service-level commitments must be agreed upon separately under a distinct agreement or maintenance arrangement. Support availability, prioritisation, and scope may vary depending on workload, resource allocation, and the nature or urgency of the request.
Users must not use Trufire products or services to engage in unlawful activity, facilitate fraud, distribute malicious software, harass or harm individuals or organisations, infringe upon intellectual property rights, or circumvent any licensing, access control, or security systems.
Trufire reserves the right to investigate any suspected misuse and to suspend or terminate access to services, products, or support where a breach of this Acceptable Use provision is identified or reasonably suspected.
Any confidential information disclosed between Trufire and a client in connection with a project or service shall be treated as confidential and must not be disclosed to any third party without prior written consent, except where required by law or a competent regulatory authority.
Confidential information does not include information that is or becomes publicly available through lawful means, or information that was already lawfully in the receiving party’s possession prior to disclosure.
Both Trufire and the client agree to take reasonable and appropriate steps to protect confidential information from unauthorised access, disclosure, misuse, or loss.
To the fullest extent permitted by applicable law, Trufire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business opportunities, loss of data, or service interruptions, arising out of or in connection with the use of its products or services.
Trufire’s total aggregate liability for any claim arising from or relating to a specific product or service shall not exceed the total amount paid by the client for that specific product or service giving rise to the claim.
Trufire may suspend or terminate any services, projects, access, or agreements at its discretion where these Terms are breached, payments remain outstanding, fraudulent or deceptive conduct is identified, or continued engagement is reasonably considered to present an operational, legal, or reputational risk.
Upon termination, any accrued rights and obligations up to the date of termination shall remain in effect. Termination does not relieve the client of any obligation to pay any outstanding fees, invoices, or charges incurred prior to the effective date of termination.
Trufire may operate or establish subsidiary brands, divisions, trading names, or business units from time to time in connection with its products and services.
Unless otherwise expressly stated, each subsidiary may maintain its own terms, policies, and agreements, including but not limited to separate Terms of Service, licensing terms, support policies, and product-specific agreements.
In the event of any inconsistency or conflict between these Terms and the specific terms of a subsidiary, the subsidiary-specific terms shall prevail solely in relation to the products, services, or activities of that subsidiary, to the extent of the inconsistency.

Trufire reserves the right to amend, update, or replace these Terms at any time at its sole discretion. Updated versions of these Terms shall take effect upon publication on an official Trufire platform, website, or communication channel, unless otherwise stated. Continued use of Trufire products or services following the publication of revised Terms constitutes acceptance of the updated Terms.
